i. Registering of an Account on the Onion Crop Advisor Platform gives the option of creating a user account (“Account”) as a farmer, student, trader, others etc (“Users”). If the Users decides to create an Account, they will provide the Onion Crop Advisor Platform with certain Personal Information, such as first and last name, email address and password, phone number, business name, location, crop name, and any other information regarding the targeted information requirement. The Users are not required to register to use the Onion Crop Advisor Platform. However, Onion Crop Advisor Platform collects personally identifiable information (email address, name, phone number etc.) from the Users when they set up a free account. The Onion Crop Advisor Platform also uses contact information to send notifications targeting dissemination of upcoming trainings/workshops or gatherings of any kind in the institute or the region specified in the interest of the Users. The Onion Crop Advisor Platform will have access to SMS, contacts in directory, location and device information. The Onion Crop Advisor Platform may share this data with its affiliates or its lending partners for the same purposes stated in this Policy. In the event that consent to this, such use of data is withdrawn in the future, the Onion Crop Advisor Platform will stop collection of such data but continue to store the data and use it for internal purposes to further improve its services.
j. A "cookie" is a small piece of information stored by a web server on a web browser so it can be later read back from that browser. Cookies are useful for enabling the browser to remember information specific to a given user. We place both permanent and temporary cookies in your computer's hard drive. The cookies do not contain any of your personally identifiable information.
k. Social Media Websites: If Users engages in any interaction with Onion Crop Advisor Platform, other Platform users or any third-party on any Onion Crop Advisor Platform social media account pages (“Social Media Pages”), they should be aware that: (a) the Personal Information that is submitted by and through such Social Media Pages can be read, collected and/or used by other users of those Platforms/services (depending on their privacy settings associated with their accounts with the applicable social media websites), and could be used to send unsolicited messages or otherwise to contact them without their consent or desire; and (b) where Onion Crop Advisor Platform responds to any interaction on such Social Media Pages, their account name/handle may be viewable by any and all members/users of Onion Crop Advisor Platform’s social media accounts. The Onion Crop Advisor Platform is not responsible for the Personal Information that the Users chooses to submit on any Social Media Pages. Their interactions with the Social Media Pages are governed by the privacy policies of the applicable social media websites. The Onion Crop Advisor Platform encourages them to review the privacy policies and settings of the Social Media Pages with which they interact to help them understand privacy practices of those social media websites.
l. You acknowledge that you are disclosing Personal Information voluntarily. Prior to the completion of any registration process onOnion Crop Advisor Platform or prior to availing of any services offered on Onion Crop Advisor Platform if you wish not to disclose any Personal Information you may refrain from doing so; however if you don't provide information that is requested, it is possible that the registration process would be incomplete and/or you would not be able to avail of the our services.
m. Automatically Collected Information which the Onion Crop Advisor Platform may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Onion Crop Advisor Platform. When you visit the Onion Crop Advisor Platform, it may use GPS technology (or other similar technology) to determine your current location in order to determine the city/town/village you are located within and display a location map. The location information may be sent to authorities for taking necessary actions and making policy decisions and for provision of services like displaying commodity rates in vicinity markets, weather based advisories etc. If you do not want the Onion Crop Advisor Platform to use your location for the purposes set forth above, you should turn off the location services for the mobile application/web browser located in your account settings. However, if the service provided by the Application/web browser requires the location services using GPS technology, such services offered by the application/web browser will/may not be available for you.
RETENTION AND DESTRUCTION
Personal Data shall be retained only as long as needed to meet the purposes for which it has been collected unless different retention periods apply under Law. After the Personal Data has fulfilled the purposes for which it was collected, the Personal Data should be securely deleted or destroyed, unless retention is otherwise required by Law.

In General, Onion Crop Advisor Platform protects Personal Data by applying reasonable technical, physical, and organizational safeguards designed to prevent unauthorized or unlawful access to or acquisition or disclosure of Personal Data or any accidental loss, alteration, destruction or damage to Personal Data. The use of Onion Crop Advisor Platform may involve the transfer of your data outside of India. In such a case, Onion Crop Advisor Platform shall strictly comply with the applicable legal provisions, in particular, in determining the adequacy of the level of protection of personal data of the recipient country of the transfer, and as regards any requirements applicable to the transfer.
YOUR CONCENT
Onion Crop Advisor works on One Time Password through SMS based verification consent for registration of new user to Onion Crop Advisor mobile application. User is required to share OTP automatically- by giving consent to Onion Crop Advisor mobile application to automatically detect and read the One time Password received by the user through SMS. User understands this process and hereby consents Onion Crop Advisor mobile application to automatically detect and read the SMS for using the same to fill the consent form as a pre-condition to use Agri Ecosystem mobile application.
Further to this, by using the Onion Crop Advisor Platform and/ or by providing your information, you consent to the collection and use of the information you disclose on the Onion Crop Advisor Platform in accordance with this Privacy Policy, including but not limited to our consent for sharing your information as per this privacy policy.
CHANGES TO OUR PRIVACY POLICY AND PRACTICES
If Onion Crop Advisor Platform decides to change the privacy policy, Onion Crop Advisor Platform will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.
INTERPRETATION
Onion Crop Advisor Platform, in its sole discretion, reserves the exclusive right to interpret, administer and apply this Policy, to make any exceptions to it, and to change this Policy at any time and for any reason. We may use your location to show your current weather information, nearby APMC Markets and commodity rates. Also we can show the blogs according to your location.
Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) describes the prohibited usage of the Products and Services provided and/or made available by or on behalf of Onion Crop Advisor and its affiliates. This AUP is an integrated part of the Onion Crop Advisor Customer Agreement (the “Agreement”). The examples and restrictions described herein are not exhaustive. We may update this AUP from time to time at our discretion by posting the latest and updated version on the Site. By using the Products and Services, you agree to be bound by the latest and updated version of the AUP as may be in force at any particular time. You acknowledge and agree that we may suspend or terminate the Services if you and/or your End User violate this AUP. Defined term used herein shall have the same meaning as defined in the Agreement.
Prohibited Activities
You may not access and use, or allow others to access and use the Services to:
violate any applicable local, national or international laws, regulations and rules.
violate or otherwise encroaches on the rights of others, including but not limited to privacy or Intellectual Property Rights.
conduct, promote, facilitate or allow illegal, unlawful, infringing, harmful or fraudulent activities, including but not limited to any activity for the purpose of harming or attempting to harm minors in any way, pornography, illegal gambling, Ponzi, network attack, phishing, or damage, surreptitiously intercept any system, program or data, monitoring of data or traffic of Services without our permission.
transmit, offer, upload, download, use or re-use, disseminate or distribute any unlawful, infringing, offensive, harmful contents or materials, including but not limited to those set out in the section "Prohibited Content" below.
transmit any data, send or upload any material that contains viruses, worms, Trojan horses, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation or security of any computer software or hardware.
attack, interfere with, disrupt or adversely affect any Services, hardware, software, systems, sites or networks, including but not limited to using high volume automated means (including robots, spiders, scripts or similar data gathering or extraction methods) to access or attack any Services, hardware, software, systems, sites or networks.
access to any portion of the Services, accounts or systems without authorization, or attempt to do so.
violate or adversely impact the security or integrity of the Services, hardware, software, systems, sites or networks.
distribute, transmit or send unsolicited email mass e-mail or other messages, promotions, advertising or solicitations (like “spam”).
fraudulently offer goods or services, or any advertising, promotional or other materials that contain false, deceptive, or misleading statements or representations.
Content that infringes or misappropriates or otherwise violates or interferes in the intellectual property or proprietary rights of others.
Content that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable, including content that constitutes child pornography, relates to bestiality, or depicts non-consensual sex acts.
Content or other computer technology or any other technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots.
Violate any charters, policies, rules or agreements promulgated by any search engines, subscription Web services, chat areas, bulletin boards, Web pages, or other services accessed via the Services or Infrastructure (“Usenet Rules”), including, without limitation, any cross postings to unrelated news groups, continued posting of off-topic messages, and disrupting newsgroups with materials, postings, or activities that are inappropriate (as determined by Onion Crop Advisor in its sole discretion).
Violate the applicable acceptable use policies of other ISPs when data, content, or other communications are carried across the networks of such ISPs.
You may not use the Products and Services to promote or condone hate or violence against people based on race, ethnicity, colour, national origin, religion, age, gender, sexual orientation, disability, medical condition, veteran status or other forms of discriminatory intolerance. You may not use the Products and Services to promote or support organizations, platforms or people that: (i) promote or condone such hate; or (ii) threaten or condone violence to further a cause.
You shall not use or offer Products and Services, or post or upload Materials, that contravene or that facilitate or promote activities that contravene, the laws of the jurisdictions in which you operate or do business.
You shall not post or upload any Materials that contain personally identifiable information, sensitive personal information, or confidential information, such as credit card numbers, confidential national ID numbers, or account passwords unless you have consent from the person to whom the information belongs or who is otherwise authorized to provide such consent.
Prohibited Content
These content prohibitions apply to any and all traffic that you transmit via the Services. Your Content shall not:.
be defamatory, obscene, offensive, hateful or inflammatory
promote violence, sexually explicit material, discrimination based on race, sex, religion, nationality, disability, sexual orientation or age or any other grounds
infringe any Intellectual Property Rights.
be likely to false, deceive or mislead.
promote, advocate, incite or assist any illegal activities.
be threatening, abuse, violate or invade third party's privacy; or
contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
Our Monitoring and Enforcement
We reserve the right to investigate any violation of this AUP or any misuse of the Services and the Website and bring it to the notice of the respective law governing /enforcing authorities as the case may be without any liability on our part. If there is any violation or suspected violation, we may take any of the following actions at our discretion (without prejudice to any of our other rights or remedies under the Agreement). Failure to comply with this AUP constitutes a material breach of the Agreement.
investigate violation of this AUP or misuse of the Services or Site;
investigate and help prevent security threats, fraud, or other illegal, infringing or harmful activities.
remove, block, disable access to, or modify any contents or materials, including but not limited to Your Content
issue a warning to you and require you to rectify
commence legal proceedings against you for reimbursement of all costs on an indemnity basis (including but not limited to, reasonable administrative and legal costs) resulting from the breach.
take further legal action against you
suspend or termination of your account, provision of Products and Services to you, your Order or the Agreement immediately, and Your Content stored in the Products and Services environment may be deleted immediately.
report your violation to appropriate law enforcement agencies or other appropriate third parties as the case me be, without any liability on our part.
Report Violation of this AUP
If you become aware of any violation of this AUP, you will immediately notify us and provide us with all possible assistance to stop or remedy such violation at the earliest. You may contact us to report any violation of this AUP.
Extent of Liability and Jurisdiction
IN NO EVENT SHALL ONION CROP ADVISOR OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OR LIABILITY OF WHATSOEVER NATURE OR ANY OTHER ACTION (CIVIL OR CRIMINAL OR OTHERWISE) IN THE EVENT OF PERFORMANCE/COMMISSION OF ANY OF THE PROHIBITED ACTIVITIES BY YOU ENUMERATED HEREINABOVE. THIS POLICY IS SUBJECT TO LAWS OF INDIA AND AN EXCLUSIVE JURISDCITION OF PUNE, INDIA .

USE AND SUPPORT
Use of Onion Crop Advisor and Services
If you can perform the following operations after logging in to the Onion Crop Advisor, it is deemed that Onion Crop Advisor and Services can be used by You: a) On the Portal/mobile app page, you can view the Onion Crop Advisor and Services. B) You can manage and maintain Onion Crop Advisor and Services by related guides provided by Associate. C) You can use the methods recognized by Associate to query the related information displayed.
Supports of Onion Crop Advisor Platform Services
You confirm that you understand that the Associates are Onion Crop Advisor Platform Products and Services providers, and Associates will solely assume any and all responsibility and liability related to Onion Crop Advisor Platform Products and Services direct and/otherwise.
Suspension
We may suspend your right to access or use the Onion Crop Advisor Platform requested to do so by Associates or on our own accord and discretion if: (a) your access and use of the Onion Crop Advisor Platform is in violation of the Acceptable Use Policy as set out in Definition Section, These Terms and/or any applicable laws and/or regulations; (b) your access and use of the Onion Crop Advisor Platform may pose a security risk /threat to the Onion Crop Advisor Platform, us or third parties under the circumstances; (c) your access and use of the Onion Crop Advisor Platform may adversely impact the functionality, availability or operation of the Onion Crop Advisor Platform; (d) it is required under any applicable law and/or regulations or governmental body; (e) your access and use of the Onion Crop Advisor Platform may subject us, our affiliates or subcontractors to liabilities or regulatory compliance risks; (f) you and/or Associates infringe or threaten to infringe or in our reasonable opinion and belief may possibly infringe a third party’s intellectual property rights; or (g) you have ceased to operate in the ordinary course, dissolved or you have resolved to enter or are placed under or applied for voluntary or compulsory liquidation (whether provisional or final) or upon you entering into business rescue proceedings or the like.
DATA PRIVACY

If you access Onion Crop Advisor Platform and Services, you agree that we may share with Associate your registration information and other details that are necessary for transaction on Onion Crop Advisor Platform and you consent for the same.
Associate Privacy Practices and Statements
You are aware that the Associates are responsible for providing privacy statements to you and describe their independent privacy practices/policies with regard to your data that they collect from Onion Crop Advisor Platform or disclosed by Onion Crop Advisor Platform. Our Privacy Statement will not apply to any Onion Crop Advisor Platform Products and Service or to Associates’ use of any of your data or information.
Your Data Protection
You are aware that the Associate shall be solely responsible for your personal data and other data protection and security independently.
USE AND SUPPORT
EXTENT OF LIBAILITY
IN NO EVENT SHALL ONION CROP ADVISOR PLATFORM OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING DAMAGES FOR LOSS OF REVENUES, PROFITS, OPPORTUNITIES, CUSTOMERS, GOODWILL, REPUTATION, DATA OR DATA USE), EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
PLATFORM LIABILITIES
ONION CROP ADVISOR PLATFORM ONLY PROVIDES THE PLATFORM AS A KNOWLEDGE MANAGEMENT PLATFORM AS PER THESE TERMS. ONION CROP ADVISOR PLATFORM DOES NOT PROVIDE ANY EXPRESSED OR IMPLIED WARRANTY OR LIABILITIES FOR ANY ONION CROP ADVISOR PLATFORM PRODUCT AND SERVICE ON THE ONION CROP ADVISOR PLATFORM. UNDER THESE TERMS, ONION CROP ADVISOR PLATFORM SHALL NOT ASSUME ANY LIABILITIES ON BEHALF OF THE ASSOCIATE AND ITS ONION CROP ADVISOR PLATFORM AND THE ASSOCIATE SHALL BE SOLELY AND FULLY LIABLE TO YOU FOR ANY LOSSES OR DAMAGES OR OTHERWISE YOU MAY SUFFER DURING YOUR USE OF THE ONION CROP ADVISOR PLATFORM PRODUCTS AND SERVICES. THERE SHALL BE NO PRIVITY BETWEEN ONION CROP ADVISOR MARKEPLACE AND YOU IN THIS REGARD. YOU SHALL KEEP ONION CROP ADVISOR PLATFORM INDEMNIFIED IN THIS REGARD IN ALL CIRCUMSTANCES.
FORCE MAJEURE
ONION CROP ADVISOR Platform shall not be liable for any delay for failure to perform its obligations under these Terms where such delay or failure is caused by a force majeure event(s) beyond its reasonable control. Force Majeure events shall include, but not be limited to, acts of God, earthquake, storms, act of war, hostility, sabotage, act of governmental order, electrical, internet or telecommunication outage, blockages, sanctions, denial orders, embargoes, pandemic and riots.
GOVERNING LAW AND VENUE
This Agreement and any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including any dispute or claim relating to non-contractual obligations) will be governed by and construed in accordance with laws of India. These Terms and Conditions are subject to an exclusive jurisdiction of the Courts at Pune, Maharashtra, India.
CHANGES AND MODIFICATIONS
Changes
I/We may change or discontinue Onion Crop Advisor Platform or change or remove any or all functionality of the Onion Crop Advisor Platform from time to time and at our sole and absolute discretion. There shall not be any individual Notice or otherwise communication given in this regard.
Modifications
We may modify these Terms, including the documents and policies referenced herein, at any time and at our sole and absolute discretion by posting a revised version on the Mobile App/Website. Except as is otherwise indicated in the modified Terms, documents or polices, the modified Terms will come into effect upon posting or notification. You undertake to review such Terms regularly on the Mobile App/Website. Your continuous use of the Onion Crop Advisor Platform after the effectiveness of such modification shall be deemed as your due acceptance of the documents and policies referenced herein and it’s particular version in force at the particular time and agree to be bound by the modified Terms as may be in force at any particular time.
Disclaimer
Non-breach
You agree that the following events or actions implemented by Onion Crop Advisor does and will not constitute a breach of these Terms: (a) Service interruptions due to network adjustment and maintenance by Associate and/or Onion Crop Advisor or slow access to the Onion Crop Advisor Services due to Internet congestion; (b) Taken into account of the special characteristics of computers and the Internet, events arising from hackers' attacks, viruses, technical renovation in the telecom departments and / or the disconnection of the backbone line; (c) Unavailability of Your services or Content caused by the operations and maintenance implemented by Associate and/or Onion Crop Advisor Platform, provided that Associate and/or Onion Crop Advisor platform gives prior notice to You with regard to data backup, service migration, or service suspension.
